Unclaimed Firearms

Purpose:
This policy establishes procedures for the forfeiture of firearms that remain unclaimed at our facility to offset accrued storage fees, in compliance with Oregon state laws governing firearms storage and disposition.

Policy:

1. Storage Fee Accrual
   As stated in our policy on unannounced firearms, a $20 per day storage fee will apply to all firearms shipped to our facility without prior notice. This fee accrues from the date of arrival until the firearm is claimed by the intended recipient or authorized representative.
2. Notification of Storage Fees
   Upon receipt of an unannounced firearm, we will make reasonable efforts to contact the sender or intended recipient, providing notice of the firearm's arrival and the daily storage fee accrual.
3. Claim Period
   Firearms must be claimed within 90 days from the date of arrival. The recipient must present valid identification, complete any necessary documentation, and pay any accrued storage fees before the firearm is released.
4. Final Notice
   If a firearm remains unclaimed after 60 days, we will issue a final written notice to the last known contact information of the sender or intended recipient, informing them of the remaining claim period, the total accrued storage fees, and the potential for forfeiture if the firearm is not claimed within 90 days.
5. Forfeiture of Unclaimed Firearms
   Under Oregon law, any firearm unclaimed after 90 days and following reasonable notification will be considered forfeited to our facility to cover accrued storage fees. At that time:
   • We may, at our discretion, transfer the firearm to a licensed firearms dealer for resale or otherwise dispose of it in accordance with Oregon law.
   • Any proceeds from the sale or transfer will first be applied to outstanding storage fees and administrative costs.
   • If sale proceeds exceed the total fees, any remaining balance will be held for the owner for a period of up to 12 months, after which unclaimed funds may be considered abandoned.

Compliance with State Law
All forfeiture, sale, and disposal actions will comply with applicable Oregon laws and regulations on the handling of unclaimed or abandoned firearms. We will ensure all necessary documentation and background checks are completed for any transfer of ownership in compliance with state and federal law.

Effective Date:
This policy is effective as of March 2022 and applies to all unclaimed firearms received at our facility on or after this date.

By sending a firearm to our facility, all parties acknowledge acceptance of this policy and agree to the terms regarding storage fees and forfeiture of unclaimed firearms.
