Unclaimed Firearms

Effective Date: March 2022

Purpose

This policy outlines the procedures for firearms that remain in our custody due to nonpayment of storage fees, inability to contact the owner, or failure to provide a return method.

Storage Fee Accrual

As stated in the Unannounced Firearm Shipments Policy, unannounced shipments accrue a $20/day storage fee beginning the day after delivery, continuing until returned.

Notification

Upon receiving an unannounced shipment, McKenzie Gunworks will attempt to contact:

• The intended recipient, and/or
• The originating sender or vendor

Notification will include:

• Date of arrival
• Daily storage fee
• Instructions for providing a return label
• Consequences of nonpayment

Claim Period

Firearms must be returned or claimed within 90 days of arrival.

If fees are unpaid or a return method is not provided:

• The firearm will be considered unclaimed, and
• Forfeiture procedures may begin under Oregon law

Final Notice

After 60 days, a final written notice will be sent to the last known contact information of the owner.

If no action is taken within 90 days of arrival, the firearm may be considered abandoned.

Forfeiture

If a firearm is unclaimed after 90 days:

• McKenzie Gunworks may transfer the firearm to a licensed dealer for resale, or otherwise dispose of it as permitted by Oregon law
• Proceeds from sale will be applied to storage fees and administrative costs

Any remaining funds beyond fees will be held for up to 12 months for the owner. After 12 months, funds may be considered abandoned.

Compliance

All actions will comply with:

• ATF regulations
• Oregon Revised Statutes governing unclaimed property
• Federal firearms laws
